Model Toxics Control Act: An Introduction

Description:

(Part 2 of 2) This updated series is a real world, applied examination of Washington’s Model Toxics Control Act (WAC 173-340) covering key issues and situations that consultants and site managers deal with and argue about, with the goal of minimizing site review time and expediting site cleanup approvals. 

In this 2-day session, attendees will participate in a review and discussion of the new model remedies for petroleum-contaminated sites, followed by a presentation from a WA Ecology representative that will highlight some of what site managers are looking for, changes to the VCP enrollment process, and an opportunity for Q & A.

Day 2 will cover 3- and 4-phase models, cross media protection pathways (soil to groundwater, groundwater to surface water, and groundwater to sediment), and introduce the concepts and the new guidance documents and implementation memos recently issued by Ecology.  This leads into a discussion of empirical demonstrations.

Participants who complete this session will gain a deeper understanding the most common issues, and how to expedite compliance by working effectively with WA Ecology site managers.

Course Topics

Day 1 will focus on Ecology's newly introduced Model Remedies for soil and groundwater contamination, including what they are, why they were developed, and when and how they apply, before covering some of the vapor intrusion regulations that are now incorporated into site assessments and cleanup.

Day 2 will cover 3- and 4-phase models, including when and how to use them; when and how they work; demonstration vs. calibration vs. verification; and other equilibrium partitioning models used by Ecology, including groundwater to surface water and groundwater to sediment. From there, we'll move into empirical demonstrations, including soil to groundwater, groundwater to porewater, and groundwater to sediment.

 

About the Instructors

Pete Kmet

Pete Kmet

Pete Kmet is a senior environmental engineer in the Policy and Technical Support Unit of the Washington State Department of Ecology's Toxics Cleanup Program. Mr. Kmet has extensive experience in site remediation, has played a key role in the development of MTCA legislation amendments, related rules, policies and technical guidance, and has presented on these topics at numerous MTCA workshops throughout the state. Mr. Kmet also serves as the mayor of Tumwater.

Priscilla Tomlinson

Priscilla Tomlinson is an expert in the fields of risk assessment, risk management, and risk communication. She has over 20 years of experience in the fields of risk assessment, toxicology, and hazardous waste. She has taught classes covering 2001 MTCA revisions and has applied MTCA rules at numerous cleanup sites.

In order to guarantee a space in a course, the tuition must be paid in full TWO WEEKS before the first day of the course by either check or credit card. State and government agencies paying with a purchase order are allowed payment under the two-week time frame if a copy of the purchase order is received by NWETC.
